You shouldn't have any problem with the K&N filter right out of the box. It's when you clean and re-oil it that you run the risk of too much oil and triggering the sensor. When you clean, just make sure not overdo the oil.
My buddy uses the ITG filters and swears by 'em. I'm thinking of making the switch to ITG when the next cleaning for my K&N is due. They're not any more expensive than the K&N.

To be honest, I can't tell if theirs any noticible difference vs. stock filter. Some cars to sound a little different with the better filter/air flow.
