Default a4 Brake Failure

I had a break failure on my car - the car continued to roll ahead even though I had the break pedal down.
It was shaking just like the ABS kicked in but it never slowed down. Instead I hit a car infront of me.
I only had time to press it up and down twice since it was such a short distance, so I couldnt determine if it was a pressure loss.

The dealer - Audi of Manhattan claims nothing is wrong, which is not really surprising - and that they checked the car.

Now... has anyone been in a similar situation and what should I do?
I am scared that it will happened again!

The car is a Certified 2006 A4 with mid 20000 miles on it.
Just been having it for 1 month.

was there anyone behind you and if so did u happen to get a witness statement from them because they could have seen your brake lights go on and that could help you fight the case

I have the people who were in the car with me as witnesses.
But both Audi USA and the dealer are second guessing me and are pointing to the clean result of the scan and test drive of the car.
My wife who works at a nyc law firm points out that there is not much we can do at this point but to get it all documented and
if it happens again (god forbid) - it will be a completely different ball game.

But to what cause... a fatal accident? It's just so messed up.

Getting a 2nd check up by independent inspectors next week.
