Default CV help needed

I have a torn inner CV boot, another problem is that I my axle is scaping the subframe.
Does that indicate a broken upper control arm?
Here are some photos.

Unlikely to have a broken upper control arm, and if it was broken, you would have a bad vibration or pull to one side. Check the springs, and fix the CV boot(s).

Thanks for the help.
I did some looking around the engine bay and noticed that my motor mount isnt on properly.
I had a mechanic rebuild the head and he changed the TB, now this happens.
Its a FWD Audi TT and I know that the motor mounts need to be removed when replacing the TB.
Should the mechanic be held accountable?
