TipTronic False Shift second gear

My 2004 Avant with under 40K on the clock seems to shift again after it gets into second gear. This happens whether in Tip or Auto mode. After it gets into second gear and the RPM's begin to rise it seems to shift again, meaning the RPM's drop and then it continues to accelerate. Then will shift to 3rd (or I will do it) in normal fashion. This only happens in 2nd gear. Dealer has checked twice for codes. Nada.
Is it possible the torque converter is releasing briefly?
Anyone have any idea why this does this?
( I have only had car for a year. Had 28K on it when I got it.)
TIA

it could be a software issue but thats what happens to automatics so I doubt its a converter thing

edit: have you done any mods to the performance? if so it will effect the gear change and software upgrade will be required

I have made no modifications to the car. How would one evaluate the software?

you need VAG to acess the tranny ECU and you could ask the dealers if a software upgrade is out there ( like a recall issue )

Dealer used VAG. No codes!
Do you know of website where service bulletins are available?

having looked at those it seems there are lots of electrical recalls ( no suprise there ) but since the tranny is controled electronicly this could be a problem,

the dealers have a dutey to tell you if there has been a recall and thats the law
