This is a brand new MMI from Audi, it was manufactured in December 2010. Just confused why it has such a delay in starting up sometimes. I am glad it does start up, even if I have to wait a few minutes, I have been without MMI since August and could only listen to what ever was in the presets or if it even turned on at all.

Doesn't matter that the MMI panel is new, the MMI system is a data loop of more than just one control module. The flash discs will update more than just the MMI panel, it will update the telematics, navigation, stereo, satellite etc. If one of those needs an update you will get malfunctions. I don't think you're gonna dodge the dealer here.
