Default Transmission issues

Some time ago (approx 27000miles) I made a claim for warranty repair because my transmission was shifting rough in lower gears. I was told at the time that everything was normal. Now with 52K miles, out of warranty, my transmission acted up several days ago.....not down shifting on the highway.....not upshifting out of first gear......staying in third gear for an extended time. For the past week, it is operating fine and actually better (smoother) than it ever has. Does anyone know what is going on? Am I screwed in the warranty arena even though this intermittent problem is on record?

I would appreciate some input. Thank you!

Thank you very much for your help. So the lifetime fluid statement is not true? or practical?
