Won ebay auction, $12.5 Import Cars of West Chester refusing to honor
 
Dealer: Import Cars of West Chester won't honor sale!!!

Last week 12/09/11 i put an offer in for a 2005 Audi S4 to a dealership in West Chester, PA. A couple hours later i was responded by them with a counter offer of the same exact offer i gave them, $12,500. I simply accepted their offer and won the car. I called up the dealership trying to put my down payment on the car and they refused to take it and said they will not be selling the car to me.

Iv'e called ebay about the situation and they told me even though they can't make the seller sell the car, there will be consequences.

As far as me being able to get this car for the price of $12,500, what grounds do i have? Iv'e read over all of the other problems like this on ebay but my situation is a little different.

I think you have about as much chance of making them sell you the car for $12,500 as they have in making you pay $25,5000 for the car. It is only biding in the ebay world what is written on this ads.

Funny thing is if ebay drops their account they will just open a new one which makes ebay’s consequences useless. Why do you think there is so much fraud on the internet?

You did not win an auction; you made an offer of $12,400. We countered with, what intended, of $19500. We did make a mistake, and countered with $12,500. You were contact immediately after it was sent by both email and phone informing you of the error and the correct counter. This was not a live auction, it was a car listed in our eBay store. There is a difference. Ebay in their user agreement, something you had to agree to in order to make a offer, states these are not binding. We did not wait, we did not make you make the trip to our dealership and try and bump you when you got here. We did the honorable thing and contacted you immediately. I'm sorry that an an error was made, but we are human!

Please refer to the main thread as i have nothing more to say, legal action is being taken and can be avoided if the dealership will come to an agreement and honor the winning offer which is a contract... (read the motortrend forum you will see why)
