Paid for New Audi Delivery Delayed, New Emissions Scandal?

I wanted to see if anyone has any suggestions on what to do here:

I intercepted an 2017 A4 Prestige w/ Driver Assistance (a rare bird) and actually paid for it on Oct 31 while it was in port in Huston.

The dealer promised it would be in by Nov 15th but then I started to hear it was delayed. They finally said they need to do a software update on the transmission and I dig up this:

VW confirms Audi's emissions test transmission anomalies - Autoblog

I actually have the title for the car now but Audi refuses to release the car from port (sounds like it might be January now). The dealer is trying to get me to take a different car even though I already have paid for and have the title for another one! They did give me an A4 loaner in the mean time but its not as good as what I've already paid for.

Anyone have any ideas? This is just about the most messed up situation I could imagine...

i had same thing happend

delayed my car delivery and finally evap system shutdown

audi has 8 monitors, if the dealer knows whats wrong and from which monitor they can shutdown and does the emissions which passes but if you check emissions paper

there will be something like ready and system not ready

easy way to find problems
i made my dealer to fix and told him if not i will report to dmv

That is why choosing trusted dealership is a must before you decided to pay anything.
