Law enforcement/judicial system question
 

I just had my stolen car recovered(see my thread, A Sad Report...adios Audi) and the two punks (both minors, 16 YO) are being held. They were armed, using my car as a getaway while burglarizing others, and involved in a high speed pursuit, my questions are:

I'm thinking these guys will be charged with the following: [ul][*]Carrying concealed weapon(s)[*]Robbery[*]Car Theft[*]Evading arrest[/ul]With that in mind, how long can these deliquents be put away for? Will they just go to juvi till they're 18, and then serve their sentence? Or will they get off scotch free (which wouldn't surprise me)?

Most likely they will be charged as adults, seeing that that is a very adult crime and they were both 'old enough to know better'

If they get off, give me a shout and I'll take care of them ;)

The SHOULD be charged as adults, but, Im betting not. A smart lawyer'll get them juvi-time and release as soon as they turn 18. Long-term, they WILL be visiting teh court-system many, many (at least 3, I'm guessing, as in 3-strikes...) more times in the future.

Yeah a smart lawyer will get them to plead to one or two counts and I'm with Jazz - since no one died they'll be out when they turn 18...

What i don't get is how an 16 yo jacked an Audi...? It can't be that easy.... [>:]

I'm pretty sure they can't afford a "smart" lawyer, they'll probably get one appointed by the state.

That was my same reaction when the cops told me their age. Hell, when I was 16, I was too busy wasting my brain cells on video games. I was very surprised how easy it was to break in, seriously, probably took them less than 2 minutes. What makes it easier too is how the fuse box is conviniently located at the side of the dash.

You left out a big piece of the puzzle in your post - the jurisdiction these crimes occurred in. I am a police officer in Washington, DC. This thing happens all the time in DC so they'd probably only get probation or at the most a few months even though they'd most likely get charged as adults. However, if you live in a *nicer* spot like Kansas, they'd proably get charged as adults and spend the next 10-20 years behind bars :)

As for the crimes they are charged with, that also depends on the jurisdiction. But if it were me in DC, I would charge them with UUV (Unauthorized Use of a Vehicle), Armed Robbery, PFCOV (Possession of a Firearm During a Crime of Violence), Destruction of Property (if they damaged your car at all during the chase), Fleeing and Eluding Police, Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, CPWL (Carrying a Pistol Without a License), and god knows what else based on what we can prove. As you can see, the name of the game is stack as many charges as you can :D

I am very sorry to hear about your car though. I've been in numerous fights with suspects and gotten injured on the job, but none of that compares to the pain of having a vehicle stolen (I've had two motorcycles stolen from me). Glad to hear that your car was recovered, although I hope it wasn't too torn up.

That's BS, that's like encouraging the criminals tocommit more crime..

I hope your car isn't in bad shape, good thing they caught the punk a$$es and hope they serve some time in the pokey. They should make it legal to shoot punks like these who are caught in the act
