Default Liability Question

Hey guys,

A friend of mine backed into a car that had illegally parked behind her a few months ago. Last week the person she hit called her (she left a note) and said he wanted her to pay for the repairs. Does anyone know how much/if she has to pay. I feel like even though he was illegally parked she probably has to pay, but the bigger concern is that it's two months later and who knows if she's paying for new damage that she didn't cause.

Secondly the estimate came in at 1100 dollars, and I feel like it's outrageous and the person who wrote up the estimate couldn't even spell, so I have concerns about their competency. So can anyone recommend a good shop in the Philadelphia area that she could go to for another estimate?

Have your frined consult a lawyer. The fact that they were illegally parked WOULD be relevent IF you could prove it. Don't suppose She took PIX, did She? On teh flip side, as you mentioned, given teh passage of time, unless their estimate is dated within a day or so of the original incident, I don't think they have much of a leg to stand on, either. Again, if She took PIX She'd be in better shape. Having left a note, She kinda put herself in the breach. Camera phones are nearly ubiquitous, nowadays. I wou;dn't DREAM of not taking pix, in a situation like that. You gatta CYA, mon frere, CYA!!!

Yeah - with the advent of camera cellphones she should have snapped pics to show the damage done and how he was parked. From what I know, if he was illegally parked then she's not liable. But then where's the proof?

We have a big problem with parking at school, she didn't take pictures unfortunately, but she's gonna check with our security office to see if they have a ticket on record. She does have a witness who was in the car also, but I know eyewitnesses aren't as valuable as anyone would like to think they are. Thanks for the help though.

Well, two words against one, assuming both words have relatively clean driving/criminal records, OUGHT to hold weight, in court. Especially of She's lucky enuff to have the other person have gotten a ticket for retarded parking.

I say she should still look into getting a lawyer, just in case it comes to that.

Hmm, can her and the witness prove that the reason she backed into the car was because it was illegally parked, and that the car was blocking it in?

i doubt they would have to pay since it was an illegaly parked car, if anythings its there fault and should stick on court, also if you have doubts about an idiot making up estimates, contest and go at it hard, be a shark, not a sheep, be neckless.

She did say she wanted to go elsewhere. I think the estimate was really high, and he said she could pick the next place, so we'll see what they say. Thanks guys.

Situation should have been handled when it happened... Why dopeople wait to do something? Are we all solazy anymore? Now that it's months later, it's going to be difficult either way.

well, if she left a note she prolly has some idea of what the damage she did was, right? is what the other guy's asking to have her foot the bill for comensurate with the damage she knows she did? If it's not, I say tell him to go suck on a frozen stop sign, or somethong...
