There is a way to "cheat" the Nystagmus test (involuntary jerking of the eyes). I have done it before, sucessfully, after drinking 7-8 beers within 2 hrs, back when I was 22 or 23.

As to not dirty my impecable reputation, I will state for therecordthatbeer was involved, but I was parked when some police came by to "investigate" my parked car.
First I heard for that, they obviously didnt make you do a roadside breath test, no way to cheat that one. Mind sharing how you did it? Another possibility is that the officer givin it to you wasnt very good. I know a way of getting out of the test, but I wont be sharin that.
I did all 3 tests twice - oncefor the officers in the first2 cars that showed up,and againbecause the cheif pulled up in his car 7-8 minutes into the search/sobriety testing. I did the heel-toe 10 steps, turn and come back 10 steps test. I did the stand on one leg and touch my fingers to my nose test. And I passed the "follow the pen with your eyes" test. I was a proficient drinker at the time, due to the practice my senior year in college.

To correct your statement you can cheat a police officer who doesnt do their job well. The other half is certainly more accurate, traffic officers deal withit all day long, they have heard it all and won't listen to it. Personally I would lose my mind if I all did was traffic. I think I will stick with robberies, assaults, and all that good stuff.

That depends on many things, when you refuse tests in MD you lose your license and other penalties. Now let's say this suspect was involved in an accident involving serious injury, you can't refuse anything. Were he/she to be just pulled over for traffic sure they can refuse the tests, but they losetheir license. I hate to repeat the phrase, but driving is a priviledge not a right. In this state when you agree to drive a vehicle you also enter a contract which states that at any time you must be willing to submit to tests requested by police.

Understandable..4th amendment is a right though, pretty important one at that i gotta say. Why doesn't your state drug test people when they get their license in that case?

Notahondaowner... I got a pace ticket on the GSP about week ago. Got a court date set in Eagleswood on the 11th. Wtf... a pace?? If she (the officer) doesn't show, can I just say I wasnt speeding, she flew up behind me and just put her lights on and pulled me over? She didn't hit me with radar and gave me a 79 in 65 pace ticket...

Main question is, how can I get it down to no points. Got a similar speeding ticket a year or two ago and plead something along the lines of "unsafe driving" which dropped it to no points and a fine. Trying to keep the record semi-clean. Any suggestions regarding this being more familiar with the laws of the land??

If you read the fourth ammendment you will notice it says UNREASONABLE searches and seizures. Judging by your forum name I can see why you are against this. I think a large amount of the population would disagree with you. If we have reasonable suspiscion that you are operating a vehicle under the influence of anything it is not unreasonable that you be tested for body/mind altering substances, especially illegal substances at that. You are operating heavy machinery that could easilykill multiple innocent bystanders if not handled properly. Why would they test them during the issuance of their license? It is when they are behind the wheel that we are most concerned. As far as I know every state has the policy that when you drive if you refuse drug/alcohol tests you lose your licenese. With every priviledge comes responsibility.

If she doesn't show then you do not have to say anything, the judge will immediately drop the ticket giving you zero points and fines. You can always plead guilty with an explanation. Just explain, "I apologize your honor, I was indeed speeding, I should have been paying more attention to my speedometer. I have no points on my record and if I could keep it that why I would greatly appreciate it. I would be willing to participate in a drivers improvement program if you felt it was necessary."
