Update!@!!@!

Do not ever buy from Fogg's Automotive in Scotia, NY.

I made my offer for this car on Thursday. It was accepted by the Sales Manager, and the salesperson sent me this email:

Quote:
congratulations!!!the deal is 23,500 ples your 2000 gti. Your tax will be
3.4% in your state.
Then they charged my card for the deposit of $500.

I got my loan
changed my insurance
got a friend to drive across the country

Then today, (two days later)the sales manager calls me and say's there was somebody in line in front of me that he didn't know about that had the right of first offer. So he is sorry and he will refund my deposit.

First of all, Is this legal?
I have an email telling me it is my car, and they took my money!

Any advice?

23,500 plus your 2000 GTI, what year was the Avant...?!? SOUNDS TO HIGH…

Yeah, I had a similar thing happen to me when I was 19 at Darcar's in Fairfax VA. They had a Washington Post ad for a Miata Limited Edition, and it was like 19,800 or something, I test drove it, took it to my shop, returned it, and then came to buy it the next day with my dad, and they said, "oh no, the car you drove want 23,000" and I was like, "yesterday you said 19,800" they pulled the oh we had two of them the other one sold yesterday and if you want, this one 23,000...

I walked and bought aMitsubishi Eclipse GSX... which I thoroughly enjoyed...

My GTI is in perfect running order, but the hood/frontend has a pretty good sandblasting from 7 years of Colorado driving. It also has 116,000 miles on it. The most I have had any dealer offer is $5000. I could sell it myself, but I need to drive something until I get my Avant, and at this rate I would have been totally screwed right now if I had sold it.

sucks, but all i can say is you should have got it in writing, and if you did, you can, atleast i think if you signed or they signed anything about the transaction being made, sue them for breach of contract, and just to be a dick and warn people about them doin **** like this, report them to the BBB and maybe if you got some freetime next weekend, pickett them... had a mechanic that screwed a friend of mine over and we stood outside his shop for a few days and he made things right like they should have been in the first place.
