Hi can anyone help me diagnose a transmission problem please?

transmission started playing up on the highway going up a hill, when i got into the city there was oil smoke coming from under the car. Checked fluid, it was dark and it had sludge on the magnets in the sump. Changed fluid and filter and it drives ok in first and second and then it slips and will not shift. There is a slight whining noise as the revs increase. Not sure if Its the torque converter or the front differential low on oil.
