It's your chip. The ECU has a hard time knowing what the loads are & it's hunting gears.
If you have Lemi, increase or decrease loads. If you increase, it will shift down & hold more, if you decrease it, 5th will hold.
Or you can either shift into 4th, or give it a little more gas slower. Shifting is also dependent on how fast you push down the pedal.

you think a tip chip would solve that or would I have to go with a full valve body upgrade?

In 5th I have to give it a lot of peddle to change gears. Mine only seams to **** when I want it to.
You can also VAG-Com the trans to hold 1st gear.

I noticed recently that my transmission will do the same.. when in TIP mode in 5th gear, if I accelerate hard it will auto shift down to 4th, then return to 5th when I let off. I never had this issue till recently, it bothers me....

If you press the pedal down about 90%ish, that is WOT, if you go past that it hits the "kick down" & will shift.
You can see where the switch is on the gas pedal, so just get used to staying on throttle with out hitting the kick down.
