I would say its a programming issue, those MMI units are really funny if they haven't been updated in a while, ESPECIALLY A 2004 model.

Doesn't matter that the MMI panel is new, the MMI system is a data loop of more than just one control module. The flash discs will update more than just the MMI panel, it will update the telematics, navigation, stereo, satellite etc. If one of those needs an update you will get malfunctions. I don't think you're gonna dodge the dealer here.
