Oil Consumption Settlement Agreement
I purchased my 2009 Audi A4 in February of this year from a private dealer. I quickly realized that I was consuming WAY more oil than what would be considered normal, to the tune of 1 quart every 275 miles. I took the vehicle into the Audi dealership, who said that the previous owners had gotten a service adjustment more than one year and 12,000 miles ago, so I am out of luck on the recall.
According to the Settlement Agreement, Section II.B. States that "...current owners or lessees of a settlement class vehicle --which-- did not previously receive a service adjustment..."
This pertains to the vehicle, so I am out of luck.
But in the Order Certifying Settlement Class and Final Approval, the judge states "...current owners or lessees of settlement class vehicles --who-- did not previously receive a service adjustment..." (Page 13, Lines 4-6)
In this case, she is referring to the owner, not the vehicle.
In the same document, she also responds to questions about the settlement and refers to the owners of the vehicle being eligible for the adjustment, not the vehicle itself (Page 53, Lines 1-12)
The previous owner never took the vehicle back to be serviced after the first part of the oil consumption test back in December 2013. Because the previous owners were careless, I am being told by the dealership that me and my vehicle are unfortunately screwed, according to the Settlement Agreement.
