ATM'S! eerrrrr!!
Ok so on November 3rd I made a cash deposit through the ATM. This was a saturday and the transaction was done at 10:57 pm. I check my account daily so I always know whats going on. On monday I had seen the my account had more money in it then I should have so I started to investigate. I seen that there was an atm transaction for the amount I depositedand then a teller transaction for the same amount. They were both just pending so I know that usually something will drop off. I happened to be up late so in the middle of the night I checked my account only to see that BOTH transactions dropped off. I called the next morning and I was already super pissed and upset. The lady said that she would give me a claim number but she wasnt going to file it yet because in THEIR system she seen the money and it SHOULD be posted at midnight. She told me to check again and if it doesnt go through then give a call back. So tuesday night I see a credit in that amount. Ok no problems looks like everything went through right? WRONG. The NEXT day the amount dropped off again. so I called again only to have them give mea credit until they figure out whats going on. That drops off again too. so finally its friday, I called that morning letting them know how frustrated I am that I deposited CASH in the atm and have made over 4 deposits through the SAME atm since then and they all cleared my account. The guy said no problem I will give you a credit during the course of the investigation and we will send you a letter to let you know the end results ( BS anyways because this is my f'n money) So yeah, I get home friday evening ONLY to see that a credit wasnt applied to my account and I only use this account to make my payments and my car payment was gonna come out and overdraft me. I cant do ANYTHING until today (Tuesday)
So now its Tuesday:
I give the bank a call and tell them the SAME story I told 4 other damn times and the lady says there is nothing they can do, the claim wasnt officially filed until saturday (BS because I called 5 days prior) and so there is nothing she can do at this time. She said that the investigators will be auditing the machine and let me know what happens.
MY concern is right now I dont trust this bank and have a gut feeling they are gonna say I never deposited anything. I asked about the video feed from the ATM and she said that is part of the investigation. It would be pretty sad if everytime I go through an ATM now I have to count the money to the f'n camera to make sure I get it. If for SOME reason they say they cant find it. After I request the video feed to show that I put money in the envelope....What else can I do?
I am soooooo frustrated right now and I deposited a pretty good sum of money and it pisses me off that I have made transactions since then and EVERYTHING was fine. What can I legally do? anything? Or do I just lose that money? Bank of america at this point is the highest on my list of hate and after this I am going to close every single account I have with them. I know it wont "hurt" them. But I am sooooo frickin mad that its been 10 days and WHERE IS MY MONEY?! errr!!
Ok I am done venting....Hopefully someone can give me some advice on what I can do..

I agree w/ VNV, go higher.. get a contact (branch or district manager)
so youre not telling your story 5-6 times.
doesnt the deposit show online? it should still show u had a transaction
that evening... even if the $$ isnt posted yet, at least theres record of the deposit.
when you say "dropped off" it's just not accounted for anymore?

one year when i was in college, i got my student loan rebate check (the extra money not used towards loans). i went to the college bank and cashed the check. this was for $5500 dollars.
i then took that 5500 and did one of those "automatic deposits" where you put the cash in an envelope and deposit it- the line for the teller was long, so the assistant guided me over to the "automatic drop" thing to do the deposit.
long story short, they "lost" my deposit and couldnt find it. i had to place about 5 million phonecalls and visited with the bank mananger almost daily for 3 weeks until it got resolved. they eventually decided i was telling the truth and credited my account for the 5500.
this was money that i needed to buy the books and art supplies, food and rent to survive at college. i had no money whatsoever for almost a month and it was VERY difficult.
needless to say, once that amount was "credited" to my account, i went in the next day, withdrew my entire balance in cash, and got a new bank. i never looked back.
because that happened to me, i never did anything like that again. all cash deposits were done at the teller window with the proper receipts. i use commerce bank now and have never had a problem....
EDIT: oh yeah i forgot to add, i saw a poll on MSN.com one day that rated the top 10 worst companies in america for customer service- and guess what bank was right up there at the top? yours....

Yeah, I'm in a credit union as well, for a variety of advantageous reasons over banks. At the same time, once it's taken care of (and likely it will be taken care of in your favor), I would stop making ATM cash deposits. Go to a teller and hand the money over in person - I don't trust cash being handled third-party for exactly reasons like this. Do it in person, and you don't have to worry about it.

IF they take to long to do this or screw you over call bank of America's corperate office and talk to them. Also you can contact the Federal Reserve consumer affairs department and file a complaint with them and they will look into. If you have to file with the fed claim they are stealing your money and they will jup all over the bank. Normally just complaining to the fed gets things in motion because if they have to investigate they will shut the entire branch down untill the investigation is over.
