Why are you buying anything? A new engine? I wouldn't settle for less than all my money back and go to a reputable dealer to buy your car.

That would be ideal, but there is little that I can do immediately. I have begun legal action, but it will take at least 3 months. I am not going to let my car, that I am paying for, sit in a garage while all of this goes on. I will be getting the repair paid for by either the dealer or Audi CPOW as well as any future costs related to this AS WELL as vehicle depreciation for not having the OE engine.
I am not rolling over for these guys.

Thanks Michael. What you can't see is that they had just pushed it up a considerable incline before pushing it in to the garage. The incline is over behind me.

You have to read your warranty and see what it covers. The bad part about this is, it's NOT a Audi defect, but damage done from an impact.
Your best bet is to contact a lawyer that deals with insurance type claims. The burden is on you to prove to Audi that the warranty covers the damage.
I know it totally sucks! This why I always have a pre-purchase inspection done on used cars! It's worth the $200!
If you are stuck, just get a used engine and throw it in there, I see them all the time for a few grand.

To tell you the truth, I am just generally skeptical of this being the cause of the problem.
I had two inspections done so that I could be extra sure of the car. Got carfax and checked with the authorities in the province that it came from. I even got it up on a hoist and checked for damage on the underside.
Do you guys think that this could have been the cause of the engine failure?
PS, ordered my new engine today. 66,000 KM, 2002 model year.
