Hey, think of it this way dude, at least you're almost done with high school, then the real games start. Haha. I don't think there's any way you could have pushed her at 5 MPH, physics wouldn't allow a push with such little force.

I've been following this and I have to agree... there's no way you could have pushed her hard enough to do the damage your talking about.

The point of 5 MPH bumpers is to absorb the impact. I you had solid bumper maybe... but not in this case! She had to have hit the SUV first.

well i just talked to insurance and he is saying the smae thing. He is assuming the first accident happened at a greater speed and that they may have a bad estimate. He said the body shop is "shady" and that his estimator will be dealing with it.

In this case where there are two accidents, there is enough reasonable doubt that you caused her damage that it would be impossible to prove. You should refuse to pay because after she hears that the retainer on the case is as much as the amount she's sueing for, she will not pursue. You really need to claim that you did not hit her first. If it was a BAM BAM accident, it is going to be quite hard to determine. So you really could get off this scott-free

i say the same thing, 5mph does not do that kind of damage. the girl is lying. theres no way in hell you'd be put at fault by logic and physics.

Are you actually under the impression that "reasonable doubt" is the legal standard in "I tapped someone in the parking lot" court "battles" - or are you just have a bit of fun?

Well i am saying yes i did rear end her at 5-mph, but i didnt cause the damage to the front. She should have had enough room in front and had her foot on the brake so she didnt hit the car in front. Proving that she either hit the car in front under her own will or was less than an inch away from teh bumper at teh time of contact. Following to closely is aganst the law so its not my fault. My insurance is perpared to pay her for rear damage after their estimater chekcs her car. They are going to say no to the front and have the investigated.

I think it is perfectly normal for your insurance to not want to foot the whole bill, but that is a rather obvious business decision and not one based on any of the "legal arguments" put forth here. You don't have to worry about how far the chick was away from the car in front of her. Let the insurance companies fight it out. What the hell else do insurance people have to do? Drink a $hitload? Beat their wives? Pick out that latest shoes with tassles on them? You may be giving some guy the thrill of his entire month with this.

Yea, and because my insurance is involved now i dont have to worry if tehy decide to sue. I just think the other guy is an idiot b/c now he has to pay teh deductible as supposed to us paying to fix his car.
