il ask again, which dealership is this? was it an Audi dealer? post some names addresses and numbers here, not only so everyone else knows not to go there, but maybe someone will read it and have had the same experience and also report them to the BBB.
if you sue them, include 'reasonable attorney and court fees' in the lawsuit and you wont have to pay to bring them to court if you win. what you do is take pictures of the hammer marks and the crack and everything, then xerox the instalation instructions for a transmission from the bently manual.
then say to the judge "it doesnt say to use a hammer in the instalation procedures. they damaged the transmission by doing so and did not tell me of the problem before i purchased it. furthermore they said it was in good working condition. it clearly is not from the pictures." also tell the judge how shady they were being by screening your calls and such. and have your mechanic testify that the dealership guy cursed him out for whatever reason.
tell them you either want all your money refunded and to return the car, or to have them pay to have a new transmission installed correctly by a certified Audi dealer. i would say thats a pretty strong case, and if you win you would get all your money back or a fixed car for free. i would say this is worth a shot.
