CORPUS CHRISTI, Texas -- A 14-year-old boy shot and killed a man who broke into his family's home Monday and threatened to kill him and his mother, Police Chief Bryan Smith said.

Smith said the man, whose name was not immediately known, confronted a woman as she was carrying groceries into her home shortly before 1 p.m.

The man forced her inside and tied her and her son up. Smith said the woman was able to loosen the binding and free her son, who got his father's revolver from a security box beneath a bed.

As the man tried to break into the room where the two were and threatened to kill them both, the teen fired a shot through the door and hit the intruder in the head, Smith said.

It would be nice if this is what happens BUT
the reality of the situation would go something like

PO "Sir put your hands on your head"
while the handcuffs go on
PO "you have the right to remain silent"
you " but officer, I was afraid for my life"
PO " I said you have the right to remain silent, do yourself a favor and remain silent"
you " BUT, BUT, BUT. . ."
PO " Sir, you just shot someone, your under arrest. the DA will decide if there will be charges pressed"

you may or may not get off at this point depending on where you live, and what they find. Lets just say for conversation that you are not charged and your shooting is "justified"

A few months will go by and you will receive a something from the dead guys family's lawyer because you are being taken to court for the financial loss for the family. Again for the sake of making this easy you're found "not resposible" for the man's death.

BEST CASE senario is that your lawyer has only charged you about $100,000 to keep you out of jail, and not resposible for the death of the man you shot. You have lost 2 years of your life in court, your job, your home ( because most people don't have $100K in liquid funds). Your life has changed forever. and that's the BEST CASE.

Worst case is you goto jail and get sued and loose that case too.

DO NOT EXPECT IF THIS HAPPENS FOR THE POLICE TO THANK YOU FOR CLEANING UP THE STREETS. You WILL be arrested and most likely you WILL be sued. But you will be alive

Now with all this said. I choose to carry daily, EVERY time I leave my home, and many times in the home I am armed too. I choose that protecting my family is more important than ANYTHING else.

Props for painting a realistic picture of what happens in most cases of self-defense shootings, as apparently too many people out there are conviced that the Sheriff is gonna give them a pat on the back and drag the intruder's body away. But where do you live that you carry a firearm every time you leave your house?

I live in a VERY quiet VERY small town in MA and I work all over New England. I've had my LTC for about 15 years and it's like putting my wallet in my pocket, it's just second nature. I know that the probability of ever needing it is low, but bad things happen to good people in good places all the time. No one is going to tell me in advance that I'll need my gun today.

There is an exception to the carry all the time statement. Deer Season opens Monday, and it is illegal to carry a handgun while hunting Deer in MA. So from October 15- December 31 if I'm planning on hunting that day iI will not be carrying my pistol. But either my bow, shotgun or blackpowder gun will be in the Allroad. All three of which I can shoot better and further than my pistol.

Reality or not, I dont give a ****. I will take my chances. I am sick of POS people getting over on the system cuz they are to lazy or to f'n stupid to get job. If the ****** wants to break into my house and take my **** that I bust my *** for, I only pray to god that my *** is home when he does it, cuz I am gonna light a fire in his ***, and his chest, and his head as well. Will I feel sorry for him or his family's suffering, hell no!! They should have raised a decent human being with something to contribute, not a dumbass. Will I have to deal with the consequences of that action, YUP. And I am more than willing to take whatever comes my way. Which in OK is nothing at all as long as I am in my home. Sometimes Oklahoma aint that bad I guess.

PHYSICAL OR DEADLY FORCE AGAINST INTRUDER
A. The Legislature hereby recognizes that the citizens of the State of
Oklahoma have a right to expect absolute safety within their own
homes.
B. Any occupant of a dwelling is justified in using any degree of physical
force, including but not limited to deadly force, against another person
who has made an unlawful entry into that dwelling and when the
occupant has a reasonable belief that such other person might use any
physical force, no matter how slight, against any occupant of the
dwelling.
C. Any occupant of a dwelling using physical force, including but not
limited to deadly force, pursuant to the provisions of subsection B of
this section, shall have an affirmative defense in any criminal
prosecution for an offense arising from the reasonable use of such force
and shall be immune from any civil liability for injuries or death
resulting from the reasonable use of such force.
D. The provisions of this section and the provisions of the Oklahoma Self-
Defense Act, Sections 1 through 25 of this act, shall not be construed to
require any person using a pistol pursuant to the provisions of this
section to be licensed in any manner.

Don't get it twisted, Hans. I work in physical security, in my p/t job. I've been licensed to carry a weapon, in teh performance of that job; which includes several hours of classes on the "use of force" and my legal rights/prividledges, as an "Armed Officer." And, being licensed to carry a weapon in teh Metro DC area (generally) makes it that much easier to obtain a CWP *because* I've takne several hours of classes informing me not only of my privilidges in being able to carry concealed, but, the rights of not only MYSELF, but anyone who may happen to *see* that I'm carrying a weapon. "Brandishing" a weapon can and WILL, in most municipalities around here, get me up to TWO YEARS, unless I'm justified in removing my weapon from whatever concealed location it may happen to be in, and perparing to take a life. (Shoot..., Shoot..., Shoot..., SHOOT TO KILL!) Some counties even REQUIRE that, when transporting a concealable weapon, it be LOCKED inside a compartment PERMANENTLY affixed in/to teh TRUNK of your vehicle, or you WILL go directly to jail, licensed, or not. THIS ensures that, should you find a reason to pull it out, "reacting to the passion of teh moment" won't be available as a defense.

EVERYBODY I know, including, I'd bet, most on these boards who are so licensed; who carry concealed, are WELL aware of their liabilities, legally and financially. LEGALLY carrying a concealed weapon is a HUGE responsibility. Believe me when I say WE KNOW THIS!!! We may make light of it, here, but I seriously doubt if anybody here who's LEGALLY allowed to carry a concealed weapon makes light of that fact WHILE they're carrying.
