What kind of damage did the airbag's failure to deploy incur? No judge would let that **** stand up.

The airbag is there exactly for this type of thing. Doesnt matter if he got a scratch or not. The sensor might have been faulty, and he certainly does have a case if he wants to go to court.

I dont really think the moron has any case. I have seen many bad crashes on the autobahn (REALLY high speed) without airbags deploying. It depends on what type of crash he had. There may have been no reason for the bags to go off. I am sure that Fords battalion of lawyers can prove that the bags were not needed if the crash merits that arguement.

Besides, someone should slap the **** of him for even considering sueing!!

The rule of law is a little bit different, here in 'Mericuh. All the lawyers'll hafta do is pull the accelerometer and do a l'ill math to find out if teh impact was great enough to caused the airbag to deploy. If so, and it dint, he stands to make MILLIONS. Honestly, he does.

Anecdote: Shortly after I took posession of my beautiful, Black (Turbo) Calibra I hadda report to teh insurance company that someone had backed into my car and smushed in teh front plastic nose thingie... The very 1ST thing the Gudachter (roughly translated as: insurance adjuster) did was check my tires. When I asked WTF he told me he was checking that I had teh appropriate speed rated tires (V, or betR) for my car. When I asked him what difference it made for an accident involving my "parked" car he told me that by law, they dint hafta pay JACK if, for ANY reason my car was involved in ANY claimable action and didn't have the appropriate gummi... Glad I had my Falkens!

My point (and, I DO have one) is: No insurance company on these shores would be able to even attempt to dodge a claim like that, in that manner. In Germany it's different. Those greyed-out speed limit signs you see up and down teh autobahn mean that there IS a speed limit, just that it' ONLY a recommended one... Anybody turns their car into bite-sized pices in one of those areas, while EXCEEDING the "recommended" speed limit will have to hope that they have an understanding insurance company because, if they're AT FAULT the insurance company is NOT obligated to pay. If you don't believe me go ask your insurance guy...

The rule of law is different. Here, in 'Mericuh, he WILL make millions off of his lawsuit. Realistically, odds are teh guy'll go out and buy an even FASTER car with his new-found wealth and, while celebrating his *good fortune* find another tree and possibly remove hinself from teh genepool. If that DOES happen, I only HOPE it's before he has a chance to reproduce and generate more stoopids with teh same family name...

I understand that, the "recommended" limit here is 130K's (about 75 mph). Anything over and insurance dont have to pay. I was only saying that airbags are designed to go off in frontal, or near frontal crashes. If he slid into a tree sideways or backwards, the bag would not deploy.

I really wanted a Calibra when I first got here. I really like those cars.

Don't 'Stangs have side bags though? Don't rilly know. Not a Ford guy, myself.

I useta LUV pickin on teh kids and their "pimped-out" Golfs, with teh coffee-can-sized exhaust, rolled fenders and dropped far enough to leave a groove in teh ashphalt... ESPECIALLY in teh rain. They'd spin and I'd LAUNCH!!! AWD is phugkin AWSOME!!! It's why I'm an AWDaholic. Nay, THE AWDaholic

If I had known you were such a Calibra fan I'd'a left my '93 Turbo (tinted, triple-black, with moonroof) with you, when I left, back in May of 2000 (of course, we din't know each other then, so it'a beena little wierd, huh?) Only needed a little cosmetic work (I explained why in a thread, not too long ago), but still ran like a champ last I heard. Sold it to one of my former O-3's for teh remainder of teh bank-note; about $2700U$D.

Back to teh topic:

I'm still betting he'll do like I said, above, and buy/wreck another, FASTER car, when he wins his suit. Any takers?

I love Fords. The Mustang does have side air bags, but they are optional on all models. So I guess we will just be talking in circles unless we know if he had them or not.

On you bet, I am gonna have to decline. If by some miraculas chance he does sue and win, then I agree with you. He will probably ruin another great car that he should not be driving.

I know a kid to had a Toyota MR2 Spyder and crashed it after two weeks, then his parents bought him a Chrysler PT Cruiser Turbo and he wrecked that too. Then in a monumental display of terrible judgment they bought him a WRX, not sure if it was an STi or not, I guess it doesn't matter though because he wrecked that too. I'm pretty sure he was sober for all of them, but I really hope he's just riding a bike now. It's probably a really nice bike though.
