ORIGINAL: apg96
u guys are just missing it. It doesnt even matter there was an accident caused by him or any of that. It only matters that teh airbag was faulty. U need to forget all teh other stuff, speeding, drunk, underage, etc... it just doesnt matter and will most likely not even be allowed in the trial.

You might want to hold off on your legal pronouncements until you expand your legal training beyond a single course in high school.

alright, this is the update:
The dealership assessed the damage wrong (thought originally to be 30K down to 9K). Obviously the ppl doin that one were retarded, so the car is no longer deemed totaled. With that said, the airbag thing has been laid to rest (as far as I know). Most ppl lost the point of my post though, I only posted that airbag part as a side comment, nothing more. The really important lesson is just to NOT DRIVE DRUNK and that screwed up sh%t happens if you do.

These BS lawsuits **** everybody off... it doesn't matter if they should win, because of legal BS or not... what plays on peoples emotions is that they DO win... we don't care why, we just don't think they should've! I mean, apg's example... a million bucks because he broke his ankle? Even if say, you broke your ankle because somebody pushed you... that shouldn't get you a million bucks! So screwed up...
A lot of those big judgements that you hear about in the paper get reduced later on. Anyone remember the "McDonald's hot coffee on the crotch" judgment? It came in at around $6Mil but ended up being more like $700K after appeals. If you think that still sounds like a lot consider that some poor old lady burned the skin off those parts that you really don't want anything to happen to and had skin from another part of her body grafted to where the skin was seriously burned. Ouch. I don't think $6Mil would even begin to cover that for me. Now you see writing all over McDonald's coffee cups that didn't used to be there and they quit making it so hot. Big whoop.
Lawyers that want crazy jury verdicts go for Mississippi, Alabama and Texas. Those juries love to "stick it to the man" like no other, but that is letting up some now as those awards are being reduced drastically if not overturned entirely. The moral is - It's not over until it's over - and really even then it's still not over. It's actually over when you get a check deposited in your bank account that doesn't bounce and all of your legal fees paid. I remember reading about a guy in Alabama that got around a $15Mil verdict against a car dealership for selling him a BMW that had flood damage as a new car. I'd be surprised if he ever got all of that.
As for the guy breaking his ankle during a break in and winning anything - I'd have to read that one to believe it. You can't set traps in your home, but you rarely have to make your property safe for trespassers. I'd tell you why, but you have probably stopped reading by now anyway......

I do remember hearing similar stories as the burglar one... or how about this example, I'm sure you've heard of many of these... the ones where people get into other peoples yards, and drown in their pool... and sue, and win. Proper fences and safety measures were taken by the home owner... but they still get their pants sued off.
hahaha, drowining in sombodies pool, then come back from the dead to sue.. thats priceless, (I know what you mean, just felt like giving you a hard time on that one)
