This has NOTHING to do with an Audi TT - But since I know most of you, I want your opinons! PLEASE

if the guy only has enough insurance to cover 100k and you're awarded 500k.. the guy is responsible for the other 400k. not anyone else, including your insurance company. you may end up getting $20 a week garnished from his paycheck for the rest of his life. that $20 amount depends on how much he makes a year. its some % they can garnish.

The other driver was at fault, it has interfeared with work/my life/physical activities the enjoyment I've had with life...all have been tarnished all effected. - I am hurt. - I live on pain killers now. - It sucks. - I walk with a horrible limp, my sex life is shot, everything is screwed up.

The guy that hit me was in his 70's/80's - I'm assuming if he didn't have the proper amount of insurrance that it will be garnished from him, however due to his age I'm assuming all his items would be sold upon his death and I would recieve the items and the $$ from it. - I'm also assuming he has life insurrance..etc. - However I'm not sure what will all happen, I have a lawyer... I was just looking for an outside prospective, - I also have UMI on my bike so if they dont cough up what is set my insurrance company will have to pay as well.

This stuff isn't fun, I'm just noting I joke about, I would rather have my body back to the way it was than have money. - Thats straight truth. - Above and beyond all things, I'm very thankful to be alive, the police officer that came to the scene said that i'm the first person he has ever seen live in a head on accident on a motorcycle helmet or not. - I got VERY lucky. - I hit the car at 30mph head first.

You are VERY lucky to have walked away with these minor injuries... compared to what could have been!
I despise bikes with a passion! For the simple fact most are cheaper and faster than cars.
So they fall into the hands young kids (not that you are one), and then you hear all about these stories of death/serious injury!

By the way, I hope you only took your knee brace off for the picture!
You need to be getting some serious rest, and letting your body heal! Don't say whether or not you're still working... Please!
Along with getting plenty of rest, your lawyer needs to be handling all of this insurance nonsense!
A good lawyer will be able to tell you the maximum asking price!
Which may be tough to listen to because how do you put a price tag on yourself. I get it believe me!

Point being, do your best to stay positive and get yourself better! That's all that really matters when all of this is said and done with.
If there is anything I can do to help please ask! I'd be more than happy to do what I can!
We're a TT family here, and when one member is down the rest want to pick ya right back up.

I have pictures without the brace, and with it, my knees are screwed up though, its not fun at all. - I'm very lucky to have walked away with what I did. - I could be dead right now. - Most would be.

Wow... that video is crazy. You should definitely be happy you're still alive man. Sorry to hear about the impairments. I was in a bad accident as well when i was younger and I still have a couple painful things that will be with me forever... nothing compared to what happened to you though.

Just out of curiosity, here's a legal question. If the man is responsible for paying $500K and he passess away, like you said his property rightfully becomes yours. Say that the property only amounts to $100K. Would someone in his family be left with the burden of paying off the remaining balance?

Good luck, I hope a fair resolution comes out of this for you.

From what I understand you can inherit debt just as easily as money.

Looks like I'm getting my dads then - haha.

I'm not sure, at that point I dont know what will happen. - My lawyer will be discussing with me what I will be and wont be getting after I speak with the surgeon this Friday.

I really REALLY hope I dont HAVE to get surgery, thing is though...I'm very VERY active... so I'm not looking forward to this. []

I'm not an attorney or anything, but I've heard people who have been in similar situations say that they've been told that you can typically get 3 times actual, provable damages for things like pain and suffering. Provable damages would include your medical bills, loss of wages, damages to your bike & equipment, legal feesand likely amounts for estimated future losses based on the types of injury.

Most attorneys and insurance companies have this down to a bit of a science, a lost finger is worth X, a lost hand more, a lost arm still more, etcin addition to the actual medical bills, etc. I think things only really diverge from set formulas for gross negligence- driving impaired or recklessly, etc.

I'd just make sure you have an attorney that is extremely knowledgable about auto accidents in general and injury awards specifically. If he or she can't look at your bills so far and hear your description of your injuries and ongoing pain and come up with a number pretty quickly that they feel strongly about, you might want to move on. Remember, the attorneymay keep 1/3 of the total award, so you want to get that straight with the attorney up front as well.
